FORGERY

What is forgery? Forgery is defined as any crime in which a person falsely creates or alters a document with the intent to defraud, deceive, or injure another.

Types of forgery – There are three main types of forgery offenses in Virginia. Each offense is unique to the type of document or item that was alleged to have been forged:
  • Forgery or uttering a forged public record or document Example – Altering the birth date on a driver’s license
  • Forgery or uttering a forged currency paper or coinage or a check Example – Signing someone else’s name on a check
  • Forgery or Uttering of any other type of document that is designed to prejudice the rights of another party

Example – Falsifying a business contract

What are the penalties for forgery? Forgery in Virginia is considered a felony, which is punishable by up to 10 years in prison and $2500.00 fine. Given the nature of this crime, the court will likely also require restitution to be paid to the victim(s).

Why should I contact an attorney? Forgery cases can be complex. However, the Commonwealth must prove that the accused had the requisite intent to commit fraud, and without such proof their case basically falls apart.
